Higher Ground has expanded its international Web3 recovery capability, building on its established United States track record to meet growing demand for coordinated recovery strategies in cross-border digital asset matters.
The expansion follows increased enquiries involving claims where the relevant agreements, counterparties and evidence must be assessed across more than one jurisdiction. Higher Ground’s broader adviser network covers Canada, Australia, selected European markets and major Asian Web3 centres, including Singapore and Hong Kong, alongside its established United States capability.
Founded in 2021, Higher Ground investigates serious governance failures involving digital asset projects and pursues recovery of invested capital where the evidence supports further action. The firm is engaged by institutional venture capital investors, private SAFT investors, ICO participants and retail token purchasers to assess available options and, where appropriate, communicate with counterparties on their behalf.
Higher Ground accepts approximately one in four matters it reviews, based on the strength of the available evidence, the ability to identify relevant counterparties and the existence of a practical pathway to recovery. Of the mandates accepted since 2021, 78% have resulted in full recovery of the invested amount for investors.
Web3 is inherently global. A fundraising round may have a United States nexus while the project operates through offshore entities or foundations. Contributors may be located across several countries, and treasury assets may move through wallets, exchanges and other digital asset infrastructure. Effective recovery work requires the project structure, investor communications and on-chain record to be assessed together, rather than treated as disconnected local issues.
Higher Ground’s expanded network allows the firm to coordinate legal, regulatory and technical expertise across the relevant markets, including securities regulation expertise where token fundraising, promotion or market activity requires it. This supports a single recovery strategy informed by where capital was raised, where assets moved and which regulatory regimes are engaged.
Higher Ground was built by lawyers, Web3 investors and operators with backgrounds in corporate and securities law. Its founding team brings more than 30 years’ combined experience, and its members have collectively built, advised on or invested in hundreds of Web3 projects.
That combination gives Higher Ground a practical understanding of how credible projects are funded, governed and brought to market, and how to identify when the record begins to depart from what investors were told.
Higher Ground’s investigations extend beyond the investment agreement. The firm tests SAFTs, token purchase agreements, fundraising materials, white papers and investor communications against the wider record, including project delivery, token distribution, treasury movements, exchange activity and the use of invested capital.
This approach helps distinguish ordinary investment failure from matters where the evidence supports recovery action, regulatory referral or formal escalation. Higher Ground does not treat every unsuccessful project as misconduct.
“Not every failed project is a recovery matter,” said Sally Al-joubory, Co-founder of Higher Ground. “Higher Ground focuses on matters where the evidence shows that what happened in practice materially departed from what investors were told. Where that threshold is met, investment risk does not remove accountability.”
Higher Ground completes its initial factual and regulatory assessment before contacting relevant counterparties. By that stage, the basis for seeking recovery has been established and the matter has been assessed across the jurisdictions engaged by the available evidence. Higher Ground gives counterparties a private opportunity to respond and reach a commercial resolution without unnecessary publicity, cost or escalation.
Direct engagement remains Higher Ground’s preferred route to recovery. If resolution is not achieved, the same evidential record can be prepared for external counsel, litigation funders, regulators or enforcement authorities in the relevant jurisdictions.
